Not guilty on rape allegations

Alan Phillips - Phillips Lawyers - criminal lawyer

Our client was charged with 4 counts of rape. The matter proceeded through the Courts and the defendant faced a Judge Alone trial.

Following cross examination of the complainant and the other evidence led by the prosecutors, it was submitted to the Judge that there were many inconsistencies in the version provided by the complainant. Few of her allegations were supported by corroborative evidence. Medical notes made following the alleged attack were inconsistent with her version of events to police that she had been strangled and repeatedly punched. She in fact had minimal injuries. Our client's DNA was located at the scene.

Rape carries a maximum of life imprisonment if convicted. Despite our client's DNA and admissions to police that he had a sexual liaison with the complainant, the inconsistencies in the evidence left a reasonable doubt as to his guilt.

He was acquitted of all four charges.
