Alan Phillips of our office was engaged to act for his client who was charged with possessing 77 grams of pure methylamphetamine. Her phone was accessed by police and she was subsequently charged with trafficking in dangerous drugs for over 15 months.
The offending started at a street level but graduated to low wholesale levels. A total of over $110,000.00 in unexplained transactions went through her account during the offending period.
The allegations were initially that she purchased 10 ounces of methylamphetamine every couple of days for on sale to her own drug syndicate, which involved runners and threats to inflict violence.
Many significant wholesale features were removed from the Crown allegations following a thorough review of the brief of evidence and extensive negotiations, resulting in a favourable sentencing basis. On our advice, our client engaged in extensive rehabilitation. Material was collated to reflect her own mental health issues at the time of the offending.
The Court sentenced her to 7 years imprisonment, to eligible to apply for parole after 13 months in actual custody. This was an exceptional result and reflected the hard work our client put into rehabilitating herself prior to being sentenced.
Ordinarily, the possession of the 77g pure methylamphetamine could of itself properly attract 12 months in actual custody. A sentence of only 13 months in custody for the possession of the large amount of drug as well as 15 months of trafficking at a consistent level was an outstanding result for our client.
