Successful appeal against sentence

In September 2020, our office instructed Tracy Thorp of Counsel in an appeal against our client's sentence imposed in the Magistrates Court.


Our client was sentenced to 2 years imprisonment for convictions relating to offences of violence and property offences. We argued that the client's medical conditions were not taken into account appropriately by the sentencing Magistrate. Our client was in a wheelchair in custody and had severe mental health issues.


Following thorough review of medical material collated by subpoena and provided by our client's family, comprehensive submissions were made in the District Court. Our client's sentence was reduced to one of 12 months imprisonment and he was released immediately.
