Rape and deprivation of liberty charges discontinued; probation with no conviction recorded for remaining drug offences

Alan Phillips of our office was engaged by his client at the outset of the matter to defend these serious charges.


We secured bail for our client in the Magistrates Court. Subpoenas were issued to relevant locations to obtain footage of the complainant acting inconsistently with the allegations she had made.


The brief of evidence was disclosed and disclosure of her phone was requested and obtained. There were messages on her phone inconsistent with the complaint.


The complainant was cross examined at a committal hearing, and the charges did not proceed in the District Court.


The remaining drug offences were finalised and the defendant received probation and no conviction was recorded. Over $20,000.00 seized by police in relation to the drug offences was returned to our client following a charge relating to the money being discontinued.


Our client was facing many years in actual jail, which was avoided by paying attention to detail and ensuring no stone was left unturned in our client’s defence.
