Alan Phillips’ client was charged with possessing 10 grams of methamphetamine, weapons, and dangerous conduct with a weapon involving a shooting with actual injury.
The client was caught via telephone intercepts during an unrelated drug investigation. Those calls intercepted our client confirming he had attended a location at the precise time bullets were fired, and further confirmation that someone was injured during the shooting.
Negotiations were pursued which resulted in our client’s drug charge being resolved in the Magistrates Court. Further negotiations on the morning of sentence allowed for an unchallenged submission to be made that our client was not the principle offender during the shooting. This was despite the telephone recordings implicating our client bringing the weapon to the scene, moments prior to the shooting.
Following advice, the client instructed us to finalise the matter promptly, which resulted in a sentence of 18 months imprisonment to serve only 6 months prior to release on parole. This was despite our client’s multiple convictions for weapon offences, and previous convictions for drug trafficking, and commercial possession of drugs.
