Bail granted for armed robbery, enter dwelling and assault occasioning bodily harm while on bail for trafficking

Alan Phillips of our office appeared for his client in the Brisbane Magistrates Court for a committal hearing with cross examination in October 2026.

It was alleged that his client had committed a home invasion, assaulting and robbing the complainant. All of this allegedly occurred only a month after he was granted bail for drug trafficking. An application was made to cross examine the complainant at a committal hearing. That was granted and the matter proceeded to a committal hearing.

Thorough cross examination of the complainant at the committal hearing led to the crown case being weakened significantly. The witness was unreliable and the prospects of securing a conviction deteriorated. An application for bail was subsequently made focusing on the weakness of the Crown case. Our client had 11 pages of not for production criminal history and a previous conviction for trafficking in dangerous drugs.
