Alan Phillips of our office was engaged to act for his client whose home was subject to a search warrant in 2025. Approximately $290,000 in cash was found at his house. He was charged with possessing tainted property.
The matter was listed for trial. The prosecution, realising a flaw in their case, amended the charge to be one of Commonwealth money laundering charge.
Saul Holt KC of counsel was briefed. An expert forensic accountant was briefed by defence and the material in the Crown case was examined thoroughly.
A request was made to cross examine witnesses at a committal hearing. The request covered a vast range of topics including querying the independence of police expert report, and the conclusions reached in relation to the case by the arresting officer. Further flaws were identified in the investigation, and other issues with the prosecution itself and weaknesses therein.
Following our request which highlighted the numerous difficulties with the Crown case, the prosecution discontinued the money laundering charge against our client.
