Alan Phillips of our office was engaged to act for his client Mr Nathan Baggaley. Mr Baggaley had previously been to trial and convicted by a jury of importing 650kg of cocaine into Australia. He was sentenced to 25 years imprisonment with a non parole period of 12 years.
His conviction was overturned. Alan Phillips was liaising with Mr Baggaley thoroughly the
appeal process and was engaged to act following the successful appeal.
The matter was again heading to trial, when thorough preparation of the matter allowed it to be negotiated such that the result was an over 50% decrease in the time required to be served in custody. This involved a thorough analysis of the brief of evidence, and importantly, working closely with his client who had an in depth knowledge of the matter. Alan Phillips drafted multiple submissions to the Commonwealth Director of Public Prosecutions which allowed the matter to be successfully resolved.
The end result was that his client was sentenced to 13 years imprisonment, and with time served he was immediately able to be considered for parole. He had done 5.5 years in custody. Proper conduct of the matter and the ability to look at all potential avenues to secure his client’s release resulted in this outstanding result.
