Mandatory 2.5 years jail avoided

Alan Phillips of our office was engaged to act for his client who was charged with supplying a short firearm. This offence carries a minimum 2 and a half years to be served in actual custody.


Our client had minimal criminal history, and two young children. He was in his mid twenties.


Following a thorough analysis of the evidence, a comprehensive and persuasive submission was made to prosecutors. It invited them to discontinue the circumstance of aggravation which required the mandatory portion to be served in actual custody.


Those submissions were ultimately accepted. Our client was sentenced to a wholly suspended term of imprisonment.
