Bail granted - Trafficking in dangerous drugs - serious organised crime - hundreds of kilograms of methamphetamine while on parole for 11 years for previous drug possession

Alan Phillips of our office was engaged to act for our client who was on parole for a significant drug possession. The client had been sentenced to 11 years imprisonment for that previous matter.


Whilst on parole, police from the State Drug Squad conducted a protracted investigation into alleged drug trafficking by the syndicate, in which police alleged our client was the kingpin in a significant organised crime network trafficking methamphetamine and other drugs.


The police charged him and objected to his bail. A thorough review of the bail objection was performed by Alan Phillips. He made submissions about the strength of the evidence, and criticized the police allegations the defendant was behind certain Threema 'handles', along with the lack of examples of drug transactions in messages obtained.


Following submissions made, the Magistrate found the allegations were tenuous and granted our client bail despite his serious and relevant history, on the provision of a one million dollar surety, reporting, curfew and other strict conditions.


Trafficking in dangerous drugs now carries a maximum penalty of life imprisonment. The circumstance of aggravation of serious organised crime carries a mandatory 7 years in actual custody on conviction.
